About these terms
These terms cover your use of this website and any order you place with us, operated by Anxiously Delicious LLC ("we", "us").
Arizona cottage food
We are registered with the Arizona Department of Health Services as a cottage food producer.
Our products are made in a home kitchen that is not subject to public health inspection and may process common food allergens.
Arizona cottage food rules limit us to shelf-stable products, so we do not make anything that has to be kept refrigerated for safety — no cream fillings, custards, cheesecakes, or similar. If you are unsure whether something you have in mind is possible, please ask before ordering.
Food allergens — please read
Our products are made in a kitchen that handles wheat, milk, eggs, tree nuts, peanuts, soy and sesame.
We list the major allergens we know each item contains, but we cannot guarantee that any product is free from any allergen, because the same equipment and surfaces are used for everything we bake. Cross-contact is possible.
If you have a severe allergy, please contact us before ordering and tell us what you need to avoid. If you are unsure, do not eat the product.
Orders and inquiries
Submitting the contact form is an inquiry, not an order. Nothing is confirmed until we reply and agree the details with you in writing.
- Deposits: a deposit is required to secure your date. We tell you the amount when we confirm your order, and it is non-refundable — it holds a date we then turn other work away for.
- Payment terms: the balance is due before collection or delivery, unless we agree otherwise in writing.
- Notice for event orders: please give us as much notice as you can. Get in touch with your date and we will tell you honestly whether we can take it on.
Changes and cancellations
- Cancellation by you: deposits are non-refundable. If you cancel with at least 72 hours notice before the agreed collection or delivery time, any balance you have paid beyond the deposit is refunded. Inside 72 hours, ingredients have usually been bought and baking has often started, so we cannot refund the balance.
- Changes by you: we will always try to accommodate a change. Ask as early as you can — some changes are not possible once baking has begun.
- Cancellation by us: if we cannot fulfil an order we will tell you as soon as possible and refund everything you have paid, including the deposit.
Collection and local delivery
Orders can be collected at a time and place we agree with you, or delivered locally where we have agreed a delivery in advance. We will confirm which applies when we confirm your order, along with any delivery charge.
Once an order has been handed over — to you, or to someone collecting on your behalf — responsibility for storing and transporting it safely passes to you. Baked goods travel badly on a warm day, and decorated items are fragile.
Storage and freshness
Our products are made fresh and contain no artificial preservatives. Once an order has been handed over, keeping it stored properly is your responsibility. Storage guidance is given with every order.
Photographs
Photographs on this site show examples of our work. Handmade items vary, and your order will not be an identical match.
Events
Event details are published in good faith and can change for reasons outside our control, such as weather or a venue cancelling. Please check before travelling.
Liability
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited or excluded.
Subject to that, our liability for any order is limited to the amount you paid for it.
Governing law
These terms are governed by the laws of the State of Arizona, and the courts of Arizona have exclusive jurisdiction over any dispute arising from them.
